Navigating the Tech Terrain: Dissecting Strategies Amidst Regulatory Challenges

Margareida Silva, a researcher at the Dutch non-governmental organization “Multinational Companies Research Center,” highlights the persistent association between technology companies’ reputation and disruption. According to Silva, the reluctance to pay fines aligns with the observed trend of major technology corporations vehemently challenging any rules imposed against them, even if eventual defeat is anticipated. She emphasizes that this strategy allows companies to effectively delay payment for years, showcasing a distinctive characteristic of the technology sector compared to industries like finance, where paying fines is still driven by an incentive to reassure both the public and investors.

Offering a legal perspective, Roman Raar, a lawyer at “Gide Loyrette Nouel” in Paris, rationalizes companies’ pursuit of appealing substantial fines. He underscores that challenging fines doesn’t imply companies can simply disregard them, but rather it’s a strategic move to challenge decisions in the hope of achieving a favorable outcome without incurring any financial penalties.

While some companies have successfully overturned or significantly reduced hefty fines, the European system contrasts with judicial frameworks in China or the United States. In these regions, fines typically conclude lengthy legal processes and are announced within settlement frameworks. Notable instances include Facebook’s record $5 billion fine in 2019 for the Cambridge Analytica scandal and Alibaba’s immediate payment of a $3 billion record fine to Chinese regulators in 2021.

Activists argue that the financial penalties imposed on these wealthy tech giants might not significantly impact them. Austrian lawyer Max Schrems, a staunch advocate for data protection rights in Europe, attributes this issue to the unequal application of rules. However, he notes the leniency of the Irish Data Protection Authority in appeal processes, often resulting in comparatively low fines.

Graham Doyle, Deputy Irish Data Protection Commissioner, defends the office’s record, emphasizing that fines are just one aspect of the regulatory process. He highlights that corrective measures are also imposed in the majority of concluded investigations. Doyle refers to an investigation into Instagram’s handling of children’s data as an example. Despite the publicity surrounding fines, activists agree that financial penalties alone cannot fully address the issues at hand.

Silva contends that instead of lenient financial penalties, the focus should shift to competition regulators intensifying their efforts. She calls for a halt to future mergers and acquisitions in the technology sector, advocating for a reconsideration of past damages and, in extreme cases, even proposing the dismantling of companies. Silva emphasizes that Meta’s challenges could have been fundamentally different had it not been permitted to acquire Instagram and WhatsApp.
